Department of Education Forms Title IX Special Investigations Team

Chicago, IL – The U.S. Department of Education has announced the formation of a new Title IX Special Investigations Team (SIT) to address complaints of Title IX violations. This initiative aims to ensure that schools across the nation uphold student rights and comply with federal law, particularly in cases involving the placement of males in women’s spaces.

The Liberty Justice Center (LJC) has commended this move, highlighting its alignment with their efforts to protect student privacy, dignity, and safety. Recently, the Department of Education’s Office for Civil Rights (OCR) initiated investigations into the Illinois Department of Education, Chicago Public Schools, and Deerfield Public Schools District 109 following a complaint filed by LJC and the Defense of Freedom Institute (DFI).

The complaint detailed significant Title IX violations, including instances where female students were pressured to share intimate spaces with a biological male, compromising their rights and safety.

Title IX is a landmark federal civil rights law in the United States, enacted as part of the Education Amendments of 1972. It states that:

“No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance”.

Significance of Title IX

  1. Gender Equality in Education: Title IX has been instrumental in promoting gender equality in education. It ensures that all students, regardless of gender, have equal access to educational opportunities and resources.
  2. Impact on Athletics: One of the most notable impacts of Title IX has been on school and college athletics. It has led to a significant increase in the participation of women and girls in sports, ensuring they have equal opportunities to compete and receive scholarships1.
  3. Protection Against Sexual Harassment and Assault: Title IX also addresses issues of sexual harassment and assault in educational institutions. Schools are required to take necessary steps to prevent and respond to such incidents, providing a safer environment for all students3.
  4. Broad Application: While often associated with athletics, Title IX applies to all aspects of education, including admissions, financial aid, and employment in educational institutions2.

Jacob Huebert, President of the Liberty Justice Center, expressed support for the Department of Education’s commitment to ending discrimination against women and girls and holding educational institutions accountable. He emphasized the importance of upholding Title IX and constitutional obligations.
